Permission
You can order as a registered user or as a guest. You need an email address to place an order. You may need to set your browser to accept both cookies and pop-ups in order to be able to use all the functions of the website. This includes adding products to your shopping cart and submitting your order.
To place an order you must be 16 years of age or older where required by applicable law to enter into a contract with Barney & close Baxter and you must be a consumer - not a reseller.
Order
The products offered on the website constitute an offer to purchase products Barney & Baxter AG ("Tommy Hilfiger Equestrian" or "Barney & Baxter"), based on data provided on the website.
All prices quoted are in EUR and include VAT. Orders and deliveries are only possible within the specified countries. When Barney & Baxter is unable to fulfill an order, Barney & Baxter will notify you as soon as possible. Orders are only accepted in normal household quantities. When you place an order, we will send you an email acknowledging receipt of your order ("Order Confirmation"). This does not mean that we have accepted your order. We will let you know within five business days whether we accept your order. In most cases, acceptance of the order occurs when the products are shipped to you. We will then send you an email confirming that the Products have been dispatched (“Dispatch Confirmation”). If we accept your order but are unable to ship the Products within five business days from the date you placed your order, we will send you a notice acknowledging your order ("Order Acceptance").
A binding contract, which includes these general terms and conditions (the "Contract"), will come into existence between you and us at the earliest upon either the confirmation of dispatch or the acceptance of the order.
Products on the website are usually in stock and ready to ship. All out-of-stock sizes are marked as unavailable. If customers order products at the same time, this can lead to inventory problems. If we are unable to dispatch an item that has already been ordered, we have the right to cancel or refuse that part of your order. You will be refunded accordingly or you will not be charged the amount. We are always working to keep our inventory as accurate as possible. Occasionally errors may occur. Our online collection is regularly replenished, so it's worth checking back regularly.

Please note that we cannot make or accept any changes to your order (address, size, colour) once your order has been received.
The fulfillment of all orders placed through the website is subject to availability. We expressly reserve the right not to accept your order for any reason, including but not limited to the following situations:
- The product is not available.
- Your billing information is incorrect or unverifiable
- Your order will be flagged by our security systems as an unusual or potentially fraudulent order
- You are under the age of 16 or not of the legal age to enter into a contract with Tommy Hilfiger
- You are a reseller

Payment and Promotional Offers
Payment method
You can pay for the products by credit card (MasterCard, Visa, American Express) and other means of payment valid in your country.
The maximum order amount depends on the payment method you choose and whether you are a registered user or a guest.
Promotional Offers
Promotional codes can only be redeemed once for purchases made on tommy-equestrian.com.
In order to successfully redeem the promotion code, the order value must exceed the voucher value.
Action codes can neither be paid out nor replaced if the order is returned in whole or in part.
You can redeem your action code by clicking on the "Enter your action code" field in the shopping cart . Once you have entered your promotional code, click Apply.
Please note:
- You can only apply one promotional code per order.
- Promotional codes cannot be applied to other promotions or sales.
- In the case of returns, it should be noted that the promotional code has been divided proportionally among the items in the order after it has been redeemed.
Data validation
During the payment process, Barney & Conduct Baxter credit checks. Based on the outcome of these audits, Barney & Baxter change, adjust or refuse an order and/or the selected payment method. Your total price

Product prices are displayed on the website. Prices may change from time to time. However, these changes will not affect orders that we have already confirmed via order confirmation.
Delivery and retention of title
Shipping

Retention of title
Products remain the property of Barney & Baxters.
Return and Cancellation of Orders
Your right of cancellation
Your online order can be returned to us within 30 days of receipt for any reason or notification.
Effects of revocation
In order to exercise your right of withdrawal, we ask that you
- inform us of your intention to return the relevant product(s) in accordance with the instructions below, and
- the return the respective product(s) within the above-mentioned 60-day period. For more information, see our Return Information.
Exceptions to the right of withdrawal
The right of withdrawal does not exist or expires in the case of contracts for the delivery of goods that are not suitable for return for health or hygiene reasons if you unseal them after delivery (e.g. underwear, swimwear, perfume , make-up) or which, due to their nature, are inseparably mixed with other items after delivery.
Return
Extended return period. After the statutory 14-day period has expired, Barney & As a gesture of goodwill, Baxter gives you an additional 46 days to withdraw from the contract. During this additional 46-day period, the same terms and conditions apply as during the statutory 14-day period, with the exception that all returned products must be returned in the condition in which you received them: returned products must be complete, unworn , unwashed, with all product labels and tags intact, and have not been used in any way other than is reasonably necessary in order to determine whether you wish to keep the products. If you fail to do the above and the value of the goods is reduced as a result, we may hold you responsible for the reduction in value.
Please ensure you do not combine returns from multiple orders in one package to ensure you receive your refund as quickly as possible.
Return of defective products
Should a delivered product be defective or defective, you are of course entitled to the statutory rights when purchasing defective products in accordance with §§ 437ff BGB in addition to the statutory right of withdrawal and the contractually granted right of return.

No exchange
Barney & Baxter does not have an exchange service. You can return any product that you are not completely satisfied with for a refund. If you would like a different product, color or size, please place a new order.
Refunds
In the event of a refund, you will receive an email notification once your returned products have been reviewed and processed.
If you are entitled to a refund, you will receive an email notification to that effect. Your refund will be paid immediately to the same card or account used to place the order.
In order to receive a full refund it is important that we receive the returned products in the condition in which you received them: returned products must be complete, unworn, unwashed, with all product tags and tags intact and must not have been used in any way other than is reasonably necessary to determine whether you wish to keep the Products.

Changes
When Barney & If Baxter decides to make changes to these Terms of Service, we will post the changed Terms of Service on the Website. You should check these regularly for changes. Existing contracts are not affected by such changes. These terms and conditions were last modified in March 2021.
Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies to these general terms and conditions, excluding the Vienna Convention on the International Sale of Goods. If you are resident in another country of the European Union at the time the respective contract is concluded, the application of mandatory legal provisions of this country shall remain unaffected by the choice of law in the preceding sentence.

2. WHAT INFORMATION DO WE COLLECT AND WHY?
2.1. To process purchases, provide customer service and other services, and process inquiries
2.1.1. Orders, purchases in stores and accounts
Online When you purchase an item through one of our websites, or, where available, through one of the digital screens in our stores, we collect your name and business name (if you are a are small businesses), your full postal address and/or separate billing address, your email address, items ordered and returned, delivery information, billing information and other data related to the fulfillment of your order. We also collect data about your use of vouchers (e.g. validity and amount) or gift cards. In addition, data is collected that you make available to us in additional fields, e.g. Your date of birth and phone number.
We use this data because it is necessary to process, execute and manage your purchase and to process your order. Please note that in some cases the requested information is mandatory. If you don't give us your name and shipping address, we won't be able to deliver your items.

When you connect your social media account to your Tommy Equestrian account (where this feature is available), you share certain personally identifiable information from your social media account with us, e.g. Your name, email address, photo, list of your social media contacts and any other information that may be available to us or that you provide to us when you link your social media account to your Connect Tommy Equestrian Account. With your consent or where we have a legitimate interest, we will engage in these activities to manage our contractual relationship with you.
